Terms of use

Welcome to India Observatory (IO), an initiative of Foundation for Ecological Security (FES). Please read these “terms of use” carefully before using the India Observatory Services (hereinafter referred to as IO Services) . These “terms of use” are part of the “Data Policy” of India Observatory and should be read in conjunction with “Data Policy” of India Observatory.

The Services available through “India Observatory” are provided by Foundation of Ecological Security. (“IO”, “FES,” “We,” "Our" or “Us”). By using IO services, you agree to abide by these terms of use and any future updates which may change from time to time as set forth in section 6 below.

By accessing and/or using IO Services you agree that, you have read, understood and agree to abide by these “terms of use” and “Data Policy”. If you do not agree to abide by these terms of use, please do not access or use India Observatory.

1. User Accounts

In order to use many of the IO Services, users may be required to create / register for an account. It will be the responsibility of users to protect the security of their accounts. Users will be responsible for the use of the IO Services and all activity that occurs under their account, including any use of account’s API keys.

Anonymous / unregistered users will have limited access to IO services.

2. Use of Applications

In order to download a IO application, users will be required to create a personal account via IO website. Should the IO Application be downloaded from a website or server administered by other entities (e.g. Google Play, Apple Store), the provision and processing of registration data and/or personal data may also be subject to the terms, conditions and policies of such entities, as applicable. IO and FES are not responsible for the treatment by other entities of information users provide, including any registration data.

When users download a IO Application, the IO Application will be saved on their computer or mobile device or any other compatible portable device. The use of the IO Application may sometimes require the processing of personal data. Such data will be saved locally on the device. Under such circumstances, IO will have no access to the information, including personal data, that user has provided and stored on the device, and IO and or FES will not be responsible for any loss or damage arising from use of IO Application or processing of information, including personal data, included or generated therein.

3. Responsibility of user

Users will acknowledge and agree that they are responsible for ensuring the integrity and security of the information that they provide when accessing or using an IO Application, including any personal data, irrespective of whether this personal data belongs to them or to a Third Party.

In the event that users are not the owner of the data they process using the IO Application, they further acknowledge and agree that they are responsible for obtaining the prior informed consent of the legitimate owner of the data.

In the event that users desire to use FES Services for “commercial” purposes, they may do so by requesting for permission in a written form to IO and or FES along with the details of :

  • IO Services intended to be used,
  • Form (existing as provided by IO or modified) in which the IO Services will be used,
  • Details of the commercial use / target users and,
  • Envisaged benefits.

4. Responsibility of India Observatory

IO will process personal data or externally sourced data in accordance with applicable rules, policies and practice. Wherever there is a specific mandate by statute or legal provisions in regard to processing of personal or externally sourced data, IO and or FES shall comply. IO and FES’s authorized vendors and subcontractors may also treat such data in accordance with any additional rules, policies and practice, which may apply to their operations.

To prevent unauthorized access, maintain data accuracy, and ensure correct use of information, IO and FES have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information IO and or FES process, consistent with the FES’s rules, policies and practice pertaining to India Observatory.

IO and or FES will not be liable for any loss or damage arising from, or directly or indirectly connected to, the use or operation of any of IO Services, including, but not limited to, any liability arising from any intentional or negligent misuse, errors, disclosure, undue transfer, loss or destruction of data that may occur.

5. Cookies & other tracking mechanism

When IO Services are used, IO may place a text file (“Cookie”) in the browser of users computer. Cookies collect information such as the type of search engine used, the sections of the Website(s) visited, and other Website usage information. Cookies allow the Services to function by tracking the application state and authenticating users on each page on the services. Users have choice of refusing Cookies by disabling them in their Internet browser settings. However, the Services may not function properly if Cookies are disabled.

When users access IO Services, IO and or FES along with its third-party service providers may use information to more effectively understand how IO Services are used and improve the usability of IO Services.

6. Updates / Notification of changes

From time to time, FES may revise its data policy on India Observatory to reflect changes in the law, process of information collection and use practices or to detail new features provided through IO Services. If FES makes any material changes it will notify users by email (sent to the e-mail address specified in user account) or by means of a prominent notice through IO Services.

FES reserves right to modify these terms at any time. All changes are effective immediately upon posting on the FES and IO website. Users should review these terms regularly for changes. Continued use of IO Services after any such changes constitutes binding acceptance of the updated Terms.

7. Compliance

While FES and IO ensure that no copyrights are violated and the content provided through IO Services is as per law, if anyone believes that any content on the IO Services infringes copyrights, they may send a notice in writing to FES and or IO at the contact details as provided in this policy.

8. Disclaimer

This website has been compiled in good faith by FES and no representation is made or warranty given (either express or implied) as to the completeness or accuracy of the information/content/data/analytics it contains when comparing the datasets from some other sources.

Adequate metadata, technical documents, methodology and accuracies, and Frequently Asked Questions (FAQ) sections have been included for guidance and reference, in this website. While, adequate care has been exercised by FES to provide and integrate information from various sources in a reliable manner for value addition, FES disowns responsibility for any inadvertent errors, beyond its limitations.

Data, Analysis, Charts, Graphs & Maps in IO Services frequently employ data from third parties. FES, IO and IO Services cannot grant permissions to the data of the original third party used in these tables, analysis, charts and maps. In these cases, please contact the third party organizations directly for the necessary permissions.

Users will indemnify FES for any loss; claims and conclusions drawn out of the direct use of the data or value-added product generated using the data/service by them or by any other third party. FES disowns liability for issues that might emerge due to use of data for any commercial and/or legal purposes.

By using the IO Services from this website, user agrees that FES will not be liable for any direct or indirect loss arising from the use of the information.

9. Governing Law / Legal

These terms and conditions set forth in this policy will be governed by and construed in accordance with the Indian Laws. Any dispute arising under these terms and conditions will be subject to the exclusive jurisdiction of the courts of India.
